The Florida Marchman Act

The Florida Marchman Act is a law that allows for the involuntary commitment of individuals who are struggling with addiction. The law was enacted in 1990 and is named after Howard P. Marchman, Jr., a state legislator who sponsored the bill.

The Florida Marchman Act allows for the commitment of an individual who is:

  • addicted to drugs or alcohol,
  • or who is exhibiting signs of addiction.

These signs can also include severe impairment or distress, significant behavioral problems, and physical symptoms related to addiction.

How Long Can Someone Be Committed?

The law allows for the commitment of an individual for up to five days During that period of time, the individual has the opportunity of being assessed and the opportunity to receive valuable treatment if necessary. At the conclusion of the five-day period, should it be determined that the person is not in need of long-term treatment, he or she can be transferred to a residential treatment facility.
